It is no part of the Custodian's duties to take any steps to call in or recover debts due to property owner's and the terms of the Moratorium Proclamation and pressure of work would preclude any action in this direction.
19. When the owner or his authorised representative reappears and establishes, to the satisfaction of the Custodian,a claim to the property, it should be restored.
A full and sufficient discharge should be obtained and an acknowledgment obtained as to the condition of the property.
All fees and expenses due to the Custodian must be paid as a condition precedent to restoration.
The utmost care will have to be exercised to ensure that, if restoration to a representative is demanded, the identity and authority of the representative are satisfactorily established.
A monthly list of cases in which property has been restored should be forwarded to the Chief Civil Affairs Officer.
20. From these notes the Custodian will realize that he may encounter many difficulties on which he may require legal advice. The services of the Chief Legal Adviser and the Legal Adviser will be available.

In relation to his duties as Custodian of Enemy Property the Custodian is reminded that the provisions of the Trading with the Enemy Ordinance were considerably amended by Regulations made under the powers conferred by the Emergency Powers (Defence) Acts and Orders in Council. Reference must be made to pages 132 139 of Hong Kong War Legislation published in 1941.
